KAMPALA: Parent Sues School for taking daughter to Nakaseke for PLE

A distressed parent has taken legal action against Genesis Nursery and Primary School in Kampala for allegedly orchestrating an unauthorized transfer of his daughter to a rural school in Nakaseke district to sit her Primary Leaving Examinations (PLE), without his knowledge. 

Isabella Bahati Ndabateze, represented by her father Robert Ndabateze, has filed a lawsuit through Bluebell Legal Advocates in Kampala, accusing the school of deceitfully transferring her to Kasagga Primary School in Nakaseke and engaging in fraudulent activities, including document falsification and misrepresentation.

Ndabateze asserts that he was shocked to discover that Isabella had taken her exams at Kasagga Primary School, a school completely unfamiliar to him, when he received her results. He emphasizes that he had registered Isabella at Genesis Primary School and was never informed of any changes. 

Despite dropping off his other children at Genesis Primary School every day, he was never notified of Isabella's re-registration at another school. Ndabateze alleges that the school's actions have caused emotional distress and mental harm to Isabella, leading to poor performance in her exams.

The lawsuit accuses Genesis Nursery and Primary School of fraudulent behavior for failing to disclose the transfer of Isabella to another school and for issuing a PLE certificate in the name of Kasagga Primary School instead of Genesis Primary School. 

Negligence is also cited, as the school allegedly failed to notify Ndabateze of the transfer and did not take appropriate measures to safeguard Isabella's emotional well-being during the exam process. Misrepresentation is another charge, as the school purportedly misled Isabella about where she would sit her exams and issued a certificate with incorrect credentials.

The plaint further states that the plaintiffs have suffered mental harm and emotional distress, including anxiety, depression, sleep disturbances, and loss of enjoyment of life, as a result of the defendant's actions. Genesis Primary School has yet to respond to the allegations.
